These Terms of Service ("Terms") govern your use of our AI-driven sentiment analysis and opinion-gathering services provided by PubSent ("we," "our," or "us"). By accessing or using our platform, you ("user," "you") agree to be bound by these Terms.

Service Description

PubSent provides a platform that enables users to gauge opinions on various topics through automated, AI-powered conversational texting. Users can upload contact lists and supporting materials to generate surveys, poll responses, and other feedback-based insights. Our system analyzes the feedback and delivers actionable sentiment reports.

User Obligations

Data Rights and Permissions
You represent and warrant that you have all lawful rights and necessary permissions to upload and use any contact data you provide to PubSent.

Contact Consent
Political Messaging: If you choose to send any text deemed by FTC standards to be political in nature, you represent and warrant that you have obtained explicit, prior consent from each contact to receive such political text messages.

Compliance with Laws
Although PubSent strives to comply with all federal, state, and local laws applicable to any part of its business operations, you acknowledge that it is your responsibility to consult with private counsel to ensure any text messages you send via PubSent's platform comply with all applicable federal, state, and local laws—including but not limited to privacy, telecommunications, and any relevant political or campaign-related regulations.
If you engage in outreach that falls under special regulatory categories (e.g., campaign finance or electioneering laws), you remain solely responsible for ensuring your actions meet all legal requirements.

Use of Platform
You agree not to use our services in any manner that violates applicable laws or regulations.
You agree not to attempt to disrupt, interfere with, or compromise the security and functionality of the PubSent platform.

False Information

Submitting false or misleading information for use in the PubSent platform is a breach of these Terms. PubSent reserves the right to determine what constitutes false or misleading information. A determination of false or misleading information by PubSent is final and may result in immediate termination of service without notice or refund.

Data Usage

No Sharing Without Consent
We expressly agree and warrant that we will never share, distribute, disclose, sell, or otherwise make available any user-uploaded data to any 3rd party without obtaining explicit, written permission from the user who originally uploaded such data.

Data Security
All user-uploaded data will be stored, maintained, and handled in accordance with all applicable federal regulations concerning the privacy, security, and handling of sensitive information.

Right to Erasure
Users retain the right, at any time, to request the removal or destruction of any data they have previously uploaded. Upon receipt of such a request (via email), we will promptly comply.

Limitation of Liability

PubSent is not liable for any indirect, consequential, or incidental damages resulting from your use of our services, including any damages arising out of text messages sent through our platform.
You assume full responsibility for determining the legal and regulatory requirements applicable to your message campaigns, including the need for contact consent.

Halt of Service

We reserve the right to pause or suspend usage of the PubSent platform if your activities negatively impact PubSent's reputation or relationships with service providers (e.g., causing high rates of blocked or spam-flagged messages).

Termination

We reserve the right, at our sole discretion, to terminate or suspend your access to our platform if you violate these Terms or misuse our services in any way, with PubSent and its managers being the sole decisions makers of what constitutes a violation or misuse.

Modifications

We may revise these Terms from time to time. Users will be notified of significant changes, and continued use of the platform after notification constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.
